iPustak Service Conditions for Use
This is an agreement between you and iPustak application (with its affiliates, "iPustak", "we" or "us"). regarding the digital spoken word audio entertainment service operated by iPustak ( the "Service Provider"). These iPustak Conditions for Use, the rules, policies and guidance that we provide are collectively referred to as the "Terms", forming part of this agreement and govern your use of the Service.
By using the Service, you agree and undertake to the following Terms:
Your Account
If you do not have an iPustak account, you will need to establish a new account to use the services. Your account will be used for iPustak user experience for the improvement of our services while providing to the customers. This will help us to response your desires, bringing new features and development changes in use of the services.
Full Access on Payment
As part of our service, full access will be given to use the purchased content only after the payment is made.
Privacy Policies
Please refer to our privacy policy which also constitutes your use of iPustak services to understand our practices. Purchased Content
Once we have made purchased content available to you for download, we encourage you to download the content promptly after its purchase. As a matter of convenience to you, we may continue to make your purchased contents available for re-download through your Service account, but we do not guarantee that such content will be available for re-download and iPustak will not be liable to you if it becomes unavailable for further re-downloading. Trial Sample
We offer customers various trial-contents before the purchase payment is done. This offer is to facilitate our customers to get some real experience as to the use of service.
Fees
Fees for purchased content and other services as applicable from time to time will be stated at the time of your purchase and provided in our help pages. The fees for purchased content may vary. Fees may be subject to tax and are non-refundable except in the specific circumstances described in these Terms.
Service Restrictions
We reserve the right to restrict use of the Service at our discretion. You should not transfer or assign your purchased contents or any Service benefits to a third party. We may take actions we deem reasonably necessary to prevent fraud and abuse, including placing restrictions on the amount of content or other services that can be accessed from the Service at only one time downloading.
Content Restrictions
You cannot (i) transfer, copy or display Content, except as permitted in this Agreement; (ii) sell, rent, lease, distribute, or broadcast any Content; (iii) remove any proprietary notices or labels on Content; (iv) attempt to disable, bypass, modify, defeat, or otherwise circumvent any digital rights management or other protection system applied to Content or used as part of the Service; or (v) use the Service or Content for any commercial or illegal purpose.
Agreement Changes
We may, at our sole discretion, change the Terms and all elements of them and any aspect of the Service without notice to you. If any change to the Terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes and the remainder of the Terms. Your continued use of the Service after we change the Terms constitutes your acceptance of the changes. If you do not agree to any changes, you must not use the Service at any cost.
Termination by Us
Our business may change over time and we reserve our right to cancel the Service in whole or in part, and to terminate your use of the Service at our discretion without notice. If we do so, no refund will be allowed based on purchase of contents unless under certain special circumstances. Our failure to insist upon or enforce your strict compliance with the Terms will not constitute a waiver of any of our rights.
